4.2. Purposes and legal basis for data processing

We may process your data for the following purposes:

  1. to perform the contracted services – on the basis of concluded contracts as a party to these contracts;
  2. to communicate with you on current matters, including the provision of services – on the basis of a legitimate interest, i.e. keeping in touch with our contractors and their employees;
  3. to communicate with you on matters concerning inquiries sent via contact forms – based on the consent granted;
  4. to organize training and enable you to attend the contracted open and/or obligatory training, to send training agendas and other training materials – on the basis of concluded contracts as a party to these contracts and based on a legitimate interest, i.e.
    organizing the events concerned, including ensuring the participation of trainees;
  5. to send commercial offers by electronic means – based on the consent granted;
  6. to pursue pursuing claims related to the concluded contracts or in order to defend itself against any claims – based on a legitimate interest, i.e. pursuing or defending against claims;
  7. for recruitment purposes – on the basis of the candidate’s consent and the legal obligation laid down in the Labor Code.

4.3. Data Recipients

Your data shall be transferred to entities providing services for the Data Controller: outsourcing, accounting, IT companies and companies maintaining IT infrastructure, public authorities, on the basis of statutory requirements.

4.4. Data transfer to third countries

The Data Controller does not intend to transfer your data to third countries or international organizations.

4.5. Data storage period

Your data shall be stored by the Data Controller for the period resulting from the provisions of law, including until any claims are time-barred, and in the case of consent for data processing – until
its revocation.

4.6. Rights of Data Subjects

You have the right to:

  • access your data and receive copies thereof;
  • have your personal data corrected;
  • demand that the processing of your personal data is restricted;
  • have your personal data deleted;
  • have your personal data transferred;
  • object to the processing of personal data;
  • lodge a complaint to the President of the Personal Data Protection Office – UODO (ul. Stawki 2, 00-193 Warsaw).

If the data processing is based on a consent: you have the right to withdraw your consent to the processing of your data. Withdrawal of consent to the processing of personal data shall not affect
the lawfulness of processing based on consent before its withdrawal.

4.7. Notice on the requirement to disclose data

Providing your data is voluntary, but necessary to fulfil the above-mentioned purpose/is a statutory requirement/is a contractual requirement/is a condition precedent for concluding a contract. No service can be provided unless you provide your data.

as part of the recruitment process in its capacity as an Employer.

  1. Purpose and basis of data processing

Your personal data falling within the scope laid down in the Polish Labor Code (Article 221) shall
be processed for recruitment purposes. This applies to the following data: first name (names)
and surname, date of birth, contact details of the job applicant (e.g. correspondence address, telephone number, e-mail address), education, professional qualifications, and employment history.

By providing data other than specified in Article 221 of the Polish Labor Code, you consent to the processing of this personal data in the recruitment procedure (pursuant to Article 6(1)(a),
and for specific categories of data – in accordance with Article 9(2)(a) of the GDPR). In this case, your consent is voluntary and may be revoked at any time.

Nexia Pro Audit shall also process your personal data in future recruitment based on your separate consent provided by ticking the appropriate checkbox in the application form, which may be revoked at any time.

  1. Recipients of personal information

Your personal data may be transferred to entities with whom Nexia Pro Audit has concluded
an agreement for the provision of services necessary for data processing, i.e. outsourcing, accounting, IT companies and companies maintaining IT infrastructure.

  1. Data storage period

Your data collected in the current recruitment process will be stored for up to 3 months, calculated from completion of the recruitment process, defined as a process of selecting a job applicant with whom an employment contract is signed.

If you consent to the use of personal data for the purposes of future recruitment, your data will
be stored for 6 months, calculated from the completion of the recruitment process.

  1. Rights of Data Subjects

You have the right to:
a) access your data and receive copies thereof;
b) have your personal data corrected;
c) demand that the processing of your personal data is restricted;
d) have your personal data deleted;
e) lodge a complaint to the President of the Personal Data Protection Office – UODO (ul. Stawki 2,
00–193 Warsaw).

  1. Notice on the requirement to disclose data

Providing your personal data in the scope indicated in Article 221 of the Polish Labor Code is necessary to participate in the recruitment procedure. Providing personal data that exceed the scope indicated under Article 221 of the Polish Labor Code is voluntary.

Withdrawal of consent to the processing of personal data shall not affect the lawfulness of processing based on consent before its withdrawal.
