4.2. Purposes and legal basis for data processing
We may process your data for the following purposes:
- to perform the contracted services – on the basis of concluded contracts as a party to these contracts;
- to communicate with you on current matters, including the provision of services – on the basis of a legitimate interest, i.e. keeping in touch with our contractors and their employees;
- to communicate with you on matters concerning inquiries sent via contact forms – based on the consent granted;
- to organize training and enable you to attend the contracted open and/or obligatory training, to send training agendas and other training materials – on the basis of concluded contracts as party to these contracts and based on a legitimate interest, i.e organizing the events concerned, including ensuring the participation of trainees;
- to send commercial offers by electronic means – based on the consent granted;
- to pursue pursuing claims related to the concluded contracts or in order to defend itself against any claims – based on a legitimate interest, i.e. pursuing or defending against claims;
- for recruitment purposes – on the basis of the candidate’s consent and the legal obligation laid down in the Labor Code;
- the implementation of internal procedures regarding whistleblower reports — based on the legitimate interests pursued by the Data Controller
4.3. Categories of Data Processing
Depending on the circumstances, the following categories of personal data may be processed:
- Identification data (e.g. first name, last name)
- Contact data (e.g. email address, phone number)
- Employment-related data
- Data related to whistleblower reports (if the report includes your personal data)
4.4. Data Recipients
Your data shall be transferred to entities providing services for the Data Controller: outsourcing, accounting, IT companies and companies maintaining IT infrastructure, public authorities, on the basis of statutory requirements.
4.5. Data transfer to third countries
The Data Controller does not intend to transfer your data to third countries or international organizations.
4.6. Data storage period
Your data will be stored by the Controller for the period required by law, including until any potential claims become time-barred, and in the case of consent-based processing — until the consent is withdrawn.
In the case of data processed in connection with whistleblower reports, your data will be stored for the period necessary to achieve the purposes for which the data is processed, taking into account legal archiving requirements and any potential claims.
4.7. Rights of Data Subjects
You have the right to:
- access your data and receive copies thereof;
- have your personal data corrected;
- demand that the processing of your personal data is restricted;
- have your personal data deleted;
- have your personal data transferred;
- object to the processing of personal data.
If the processing is based on your consent, please note that you have the right to withdraw your consent to the processing of your personal data at any time. Withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal. 2.Purpose and basis of data processing
Your personal data may be processed for the purpose of:
Conducting the recruitment process – Article 6(1)(b) of the GDPR.
Fulfilling legal obligations arising from applicable law – Article 6(1)(c) of the GDPR.
Implementing internal procedures related to whistleblower reports – based on the Act of 14 June 2024 on the protection of whistleblowers and Article 6(1)(f) of the GDPR.
Protecting the legitimate interests of the Controller, such as pursuing claims or defending against claims – Article 6(1)(f) of the GDPR.
Participation in future recruitment processes, including processing of excess data (i.e. data beyond legal requirements, e.g. your image) based on your voluntary consent – Article 6(1)(a) of the GDPR.
Providing additional personal data beyond the scope of Article 221 of the Labor Code will be considered as your consent to the processing of such personal data in the recruitment process (based on Article 6(1)(a), and in the case of special categories of data – Article 9(2)(a) of the GDPR). This consent is voluntary and can be withdrawn at any time.
Nexia Pro Audit will also process your personal data for future recruitment processes if you give separate consent during the application form submission, which can be withdrawn at any time.
3. Recipients of personal information
Your personal data may be transferred to entities with whom Nexia Pro Audit has concluded an agreement for the provision of services necessary for data processing, i.e. outsourcing, accounting, IT companies and companies maintaining IT infrastructure.
4. Data storage period
ur personal data collected during the current recruitment process will be stored for the duration of the recruitment and up to 6 months after its completion, understood as the selection of a candidate and signing an employment contract.
If you have given consent for your personal data to be used for future recruitment purposes, your data will be stored for 12 months from the end of the recruitment process.
In the case of data processed in connection with whistleblower reports, data will be stored for the period necessary to achieve the purposes for which the data is processed, taking into account legal archiving requirements and potential claims.
If claims are pursued or defended against, data may be processed for the period required by law or until the conclusion of any court proceedings.
5. Whistleblower Protection
n accordance with the Act on the Protection of Whistleblowers dated 14 June 2024, the Data Controller informs that mechanisms for reporting legal violations are in place, and guarantees protection for whistleblowers against retaliation. Persons participating in the recruitment process have the right to report irregularities through dedicated communication channels. The Controller has implemented whistleblower protection mechanisms. 6. Automated Processing
Your personal data will not be subject to automated decision-making, including profiling, as referred to in Article 22(1) and (4) of the GDPR.
7. Rights of Data Subjects
You have the right to:
a) access your data and receive a copy (Article 15 GDPR)
b) rectify your personal data (Article 16 GDPR)
c) request restriction of the processing of your personal data (Article 18 GDPR)
d) erase your personal data (Article 17 GDPR)
e) data portability (Article 20 GDPR)
f) object to the processing of your personal data (Articles 21 and 6(1)(f) GDPR)

Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

The Data Controller does not intend to transfer your data to third countries or international organizations.
9. Notice on the requirement to disclose data
Providing your personal data in the scope indicated in Article 221 of the Polish Labor Code is necessary to participate in the recruitment procedure. Providing personal data that exceed the scope indicated under Article 221 of the Polish Labor Code is voluntary.
Withdrawal of consent to the processing of personal data shall not affect the lawfulness of processing based on consent before its withdrawal.
